Our social media presence

This privacy policy applies to the following social media sites

Data processing by social networks

We maintain publicly accessible profiles in social networks. The individual social networks we use are listed below.

Social networks such as Facebook, X etc. can generally analyze your user behavior comprehensively when you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). Visiting our social media presences triggers numerous data protection-relevant processing operations. In detail:

If you are logged into your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, this data is collected, for example, via cookies that are stored on your device or by recording your IP address.

With the help of the data collected in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you inside and outside the respective social media presence. If you have an account with the respective social network, the interest-based advertising can be displayed on all devices on which you are logged in or were logged in.

Please also note that we cannot track all processing operations on the social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. For details, please refer to the terms of use and data protection provisions of the respective social media portals.

Legal basis

Our social media presence is intended to ensure the widest possible presence on the internet. This is a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR. The analysis processes initiated by the social networks may be based on different legal bases, which must be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6 para. 1 lit. a GDPR).

Responsible party and assertion of rights

If you visit one of our social media sites (e.g. Facebook), we are jointly responsible with the operator of the social media platform for the data processing operations triggered during this visit. You can assert your rights (information, rectification, erasure, restriction of processing, data portability and complaint) both against us and against the operator of the respective social media portal (e.g. Facebook).

Please note that, despite the joint responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options are largely determined by the corporate policy of the respective provider.

Storage duration

The data collected directly by us via the social media presence will be deleted from our systems as soon as you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies. Stored cookies remain on your end device until you delete them. Mandatory statutory provisions – in particular retention periods – remain unaffected.

We have no influence on the storage period of your data that is stored by the operators of social networks for their own purposes. For details, please contact the operators of the social networks directly (e.g. in their privacy policy, see below).

Your rights

You have the right to receive information about the origin, recipient and purpose of your stored personal data free of charge at any time. You also have the right to object, the right to data portability and the right to lodge a complaint with the competent supervisory authority. You automatically transmit your telephone number and, if applicable, your name. However, it is only necessary to call up this page or this app if you wish to communicate with us using it.

In general, we would like to point out that the security of individual services may depend on the user’s account settings. Even in the case of end-to-end encryption, the service provider can draw conclusions about the fact that and when users communicate with us and may collect location data. We have no influence over this and cannot understand or control it.

Further information on data processing by the messenger service provider can be found here: https://www.whatsapp.com/privacy

2.1. Purposes of the processed data

Communication is changing and with it, communication channels – and opportunities – are also changing. We are interested in a fast and uncomplicated exchange with users.

We use the WhatsApp Business messenger service for this purpose.

Legal declarations (offers, contracts or contract amendments) are not made via WhatsApp Business and cannot be accepted. We are also available to you personally for all topics at Tel: 05292-72200 or info@stahlbau-menke.de.

2.2. Legal basis of the processed data

We use the messenger service to communicate easily with our customers/suppliers/applicants. The communication is intended to ensure faster and simpler communication between the parties and is used in addition to the usual means of communication. The use of the messenger service is voluntary by customers/users/applicants on the basis of our legitimate interests pursuant to Art. 6 para. 1 lit. f) GDPR. Users are aware of the corresponding risk.

In the case of mutual communication via the messenger service, we process your data to the extent necessary to answer or process the request. This is done on the basis of your consent in accordance with Art. 6 para. 1 sentence 1 lit. a) GDPR and in the case of contractual or pre-contractual initiation, in accordance with Art. 6 para. 1 lit. b) GDPR.

If the controller processes private personal data of an employee for operational purposes using a messenger service, this is also done on the basis of consent in accordance with Art. 6 para. 1 sentence 1 lit. a) GDPR.

2.3. Data categories

Various types of data are processed when you use the messenger service. The scope of the data depends largely on the information you provide in your request/message. This may include the following data categories, for example

– Master data (surname, first name, address)
– Contact data (e-mail address, telephone number),
– Content data (text entries, photographs, videos).

Furthermore, data is also processed directly by the WhatsApp Business messenger service; this may include the following data categories, for example

– Usage data (interests, access times),
– Meta and communication data (device information, IP address)

2.3.1 Automated decision-making (including profiling)

2.4. Recipient of the data

Within our company, those internal departments that require your data to fulfill the above-mentioned purposes will receive it. Personal data that is processed in connection with your request will not be passed on to third parties unless it is intended to be passed on. The provider of the messenger service necessarily receives knowledge of the above-mentioned data.

2.5. Data processing outside the European Union

WhatsApp Business is a service provided by a provider from the USA. Personal data is therefore also processed in a third country.
